Addressing Procedural Delays in a Child’s Asylum Case

Ali and Sara (*fictional names), a married couple from Iran, had already received refugee status in Poland in 2024 with the support of ELIL’s legal team. When their daughter Leila (*fictional name), born in Poland, needed international protection, they turned to our lawyers again for guidance.

In late 2024, our team prepared and submitted Leila’s asylum application. Over the following months, we stayed in constant contact with the family, providing updates and explaining each step of the process.

The case faced several obstacles. Different Border Guard units gave contradictory instructions, requiring the family to resubmit the application. Early 2025, after direct intervention, we arranged for Ali and Sara to submit the application in person and guided them through the required formalities.

Even after repeated follow-ups, the Office for Foreigners did not respond within the statutory deadlines. Our team then took decisive legal action, submitting a formal request for an immediate decision and later a complaint to the Refugee Board, the supervisory authority.

Thanks to this persistent legal strategy Leila was granted refugee status, securing her safety and legal protection.
